The Service and its original content, features, and functionality are and will remain the exclusive property of BreakawayStats and its licensors. The Service is protected by copyright, trademark, and other laws.

NHL statistics and data remain the property of the National Hockey League, and MLB statistics and data remain the property of Major League Baseball. Team names, logos, and player names are trademarks of their respective organizations.

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our Service, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

IN NO EVENT SHALL BREAKAWAYSTATS, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED $100.

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. You use the Service at your own risk.

Paid subscriptions renew automatically at the interval and price shown at signup until you cancel. You can cancel at any time through the link in any email, the customer portal, or by contacting us. Cancellation stops future renewals; it does not refund the current billing period. Billing for seasonal plans stops automatically at the end of the applicable sports season.

Your subscription price is locked to the rate you signed up at and will not increase for as long as your subscription remains continuously active. If your subscription lapses or is cancelled and you later resubscribe, the then-current price applies.

Failed payments. If a renewal payment fails, we may attempt to charge your payment method again over a recovery period. If payment cannot be collected during that period, we reserve the right to suspend or cancel your subscription and access to paid features at our discretion, without further notice. Restoring access after a cancellation for non-payment may require resubscribing at the then-current price.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach the Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of the Terms which should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.

These Terms shall be interpreted and governed by the laws of the United States, without regard to conflict of law provisions.

Any disputes arising from these Terms or the Service shall be resolved in accordance with applicable federal and state law.
